Stipe v. State ex rel. Board of Trustees of Oklahoma Public Employees Retirement System,
2008 OK 52 (May 27, 2008): State Retirement: Embattled former state senator Gene Stipe applied for retirement benefits based upon his 54 years of public service. The OPERS denied his application on the basis that his federal criminal convictions resulted in Stipe forfeiting his retirement benefits. The District Court reversed and reinstated the benefits, finding that the federal crimes to which Stipe plead guilty had no connection to Stipe's service in office and did not violate his oath of office. The Supreme Court agreed and AFFIRMED. Although this is not a criminal case, it is worth taking note because of the collateral effects of certain felony convictions on state retirement.
