Collier v. State,
No. F-2004-1091 (Okl.Cr., February 3, 2006) (unpublished): Trafficking case that was tried at a bench trial and resulted in a 12 year sentence. The trial court graciously modified the sentence to 5 years. Still, Collier appealed and is glad he did because COCA reversed and remanded on a chain of custody issue(!) The cops recovered marijuana from Collier's vehicle but failed to account for the different packaging of the drugs when received by the OSBI as when it was found; and also the State failed to establish that during the ten days the drugs were awaiting transport to the OSBI the location was not secured. The Court held that the State did not show that law enforcement officers took reasonable precautions to preserve the original condition of the evidence. Good case on this issue and also cites three good winners on this issue.
