ROBERT CARTER

heard the magic words on February 9, 2005 in Oklahoma County in Judge Twyla Gray's courtroom over a dejected Pat Garrison and Steve Deutsch.  Male client and female passenger in car end up in collision with other car, clearly the fault of the car client was in, client injured and female passenger unfortunately injured severely (permanent vegetative state). Client confesses to cops he was the driver, Trooper claims the physical evidence at the scene proved client was the driver, and blood work reveals presence of marijuana, ecstasy, cocaine and valium; no doubt client stoned out of his mind.  Rec is the max on a charge of DUI/GBI (five years) so Robert suits up for trial.  Trooper prepared hi-tech computer animation of the crash.  Robert rebuts with defense expert Larry Hall who testified that the physical evidence absolutely proved that client was the passenger ("road rash" on client's right arm).  Robert had to impeach the client's confession and showed the jury photos of what client looked like on the night of the crash ("would you believe this guy was capable of knowing whether he was driving?) and client actually had no recollection at all of the events. The defense contested only one element: that client was the driver.  Twelve in the box found reasonable doubt and Robert walked his client out of one of the toughest courtrooms in the state.
