JIM FRANSIEN

(Tulsa), represented client charged with Kidnaping, AFCF, and Violation of Protective Order in Tulsa County. State offered 10 to do.  No thanks, let's go to trial.  State alleged client kidnaped an adult woman who had a PO against client.  Facts showed she was with client but issue was whether she was "kidnaped."  Client took the stand and testified in his own behalf despite the prior conviction for A&B on a police officer.  During deliberations on Thursday, February 24, 2005, the jury sent a note asking, "What is the minimum on violation of a protective order?"  Sweet.  The court did not tell them ("you have all the law needed to blah, blah, blah...."), but the jury came back shortly thereafter with a "not guilty" on the kidnaping but a guilty on the PO violation.  The jury really hammered Jim's client with a $10–that's ten dollar--fine.  Client, who had been in jail for six months, walks out with Jim, who got to take Friday off.  Great result, Jim.
