Grand Jury (State)
State v. Hall,  2008 OK CR 15 (May 23, 2008):  Grand Jury (State):  This case involves a challenge to a state grand jury on the grounds that two alternate grand jurors were present in the room when the grand jury heard evidence.  Judge McElwee in Oklahoma County granted the motion quash, Judge Virgil Black affirmed that part of the order, and the State appealed.  HELD:  1) the presence of alternate grand jurors was not error; 2) the statutory provisions restricting the presence of other persons in the grand jury room and those allowing for alternates can be harmonized; and 3) the brief absence of one of the grand jurors during a portion of testimony did not vitiate the findings of the grand jury.  NOTE:  This case involves indictments obtained through investigation of the Hinton Economic Development Authority and includes this line-up of defense counsel:  Mack Martin, Stephen Jones, Garvin Isaacs, and Chris Eulberg.
